TERMS AND CONDITIONS OF CAIRN LODGES Ltd (HOLIDAY LODGES)

Please Note:

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide on the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by post or email.

TERMS AND CONDITIONS

Your booking should be for holiday purposes only unless otherwise agreed in writing. The Lodges must not be used for party purposes, weddings or filming without prior written agreement or email confirmation of same is acceptable.

Your contract is between you and the Owner of the properties and is subject to the following conditions.

Each Lodge is as described on our web site www.cairnlodges.com. The accommodation is of a high standard and will be returned in the same condition.

Cairn Lodges Ltd reserves the right to change or amend their terms and conditions at any time.

PERSONAL DETAILS

Personal information provided to Cairn Lodges Ltd will not be shared with any third party.

YOUR HOLIDAY LODGE

You can arrive at your accommodation after 16.00 hrs on the start date of your holiday. Any arrivals after 7pm should be notified in advance.

You must have please vacated the property by 10.00 hrs on your final day unless agreed otherwise by both parties.

You agree to keep the lodge clean and tidy and to leave it in a similar condition of cleanliness to when you arrived.
Any additional cleaning of the property, following your departure, beyond the normal amount reasonably required, may be charged for.
If you have not stayed with us before, a fully refundable good housekeeping/ breakage deposit may be requested at the discretion of the owners
If requested this would be required on arrival and returned on day of departure, following handover.
The numbers in your party must never exceed the stated Lodge capacity for the whole Lodge, without express written prior consent.

Please note that candles are not allowed in the Lodges.

PAYMENT

We accept BACS TRANSFER ONLINE

And card payment online through Holiday Rent Payment

Please note for overseas guests we are unable to pay bank charges.

We would ask that you email us once your BACS transaction has been instructed by you, so that we can check for its deposit arriving safely within our account and email confirmation of this and your booking to you.

BOOKING

You must be 21 years or over when you book the accommodation.
The Owner has the right to refuse any booking prior to the issuing of any confirmation in writing.
When you receive your confirmation you must check all the details carefully for accuracy and contact the Owner immediately if you find any discrepancy.

To improve the facilities within the Lodges, Cairn Lodges reserve the right to alter or amend the facilities at Cairn Lodges. Cairn Lodges reserve the right to change any of the specifications of the Lodges at any time.

RENTALS AND CHARGES

In order to secure a booking you need to make a 25% deposit payment. On receipt of your deposit the owner will confirm your booking by email or automated email if you have booked online and acknowledge receipt of your deposit with an account for the balance due 8 weeks before your date of arrival. You are then responsible for the balance of the rental. If a week is booked 8 weeks or less until the rental commences the full rental is payable upon booking and is non refundable in the event of cancellation.
If the balance is not received 8 weeks prior to arrival of the dates provisionally booked by you it will automatically become available for re-let and the deposit will be forfeited in full.

CANCELLATION

we must be notified immediately by email at Contact@cairnlodges.com of the cancellation. The day on which we receive your email cancellation is the day on which your reservation is cancelled. We will endeavour to re-let your booking to the best of our ability.

please note that should you cancel your booking prior to the balance due date your deposit is non-refundable and forfeited in full and the balance is not then due. if your payment has not been received when requested 56 days before your commencement date, we will assume that you wish to cancel and we reserve the right to cancel the stay, in which case the deposit will be forfeited in full but we will not do so without considerable effort to reach you by both telephone and by email. Failure to respond to the balance requests timeously will also be deemed cancellation of booking and forfeiture of the deposit. We will make every effort to make contact with the guest by email and by telephone.

In the event you need to cancel your booking after the balance has been paid in full, BOTH the balance and the deposit will be retained ny us however we will re-advertise your date having the sole discretion of offering dates out at a reduced rate to assist re-booking for you and every effort will be made to re-let your rental. if we are able to re-let your dates, we will refund you the final letting amount which may be less than you paid i.e. if the final letting price was discounted or only some of the days are re-let less a £50 administration fee for re-advertising and administration of the booking. We always recommend you ensure that your holiday insurance covers you in the event of any cancellations. if you have a cancellation week/dates with us which is any holiday dates re-advertised 56 days or less from arrival date or a special offer advertised i.e. one night unique stays please note the payment remains strictly non refundable however in the event we are able to re-let the date we will reimburse you less a £50 admin fee to cover the costs of advertising/marketing and rebooking the dates. please ensure that your holiday insurance covers you for your stay.

CANCELLATION BY US

Each booking is made in good faith in the belief that the lodge will be available to the client on the date stated on the booking form. If for any reason due to circumstances out-with our control the Lodge is not available we are unable to guarantee provision of alternative accommodation however a full refund of your original rental fee paid to us would be made. For the avoidance of doubt adverse weather conditions which may prevent travel for any reason, fog, delayed flights, ferry disruption, road closures are not deemed a circumstance out-with our control for this clause which would give rise to a refund. Normal holiday insurance is recommended at the time of booking as we cannot be held responsible for weather interruption to your travel arrangements.

ADVERSE TRAVEL CONDITIONS

In the event of ferry/plane disruptions due to bad weather conditions or any form of industrial action we cannot be held responsible for non-arrival at the lodges and strictly no refunds will be given. We would recommend all guests to have normal travel insurance in place at time of booking.

LODGES WITH HOT TUBS

The hot tub is included in the price of your holiday. Please note to ensure your stay is as enjoyable and comfortable as possible, we may require to refill / refresh the hot tub water during the rental for your comfort, however in the event that this process requires to be carried out it would be conducted as swiftly as possible with the minimal amount of disruption.

By email and with your booking confirmation you will be given a safety guidelines sheet. By accepting these terms and conditions, you accept that you have read & understand the hot tub safety terms & conditions.

RESTRICTION ON RENTAL

Cairn Lodges Ltd reserve the right to refuse any booking prior to the processing of the booking deposit.

We reserve the right to remove person or persons from the property due to unreasonable behaviour, or any behaviour that adversely impairs the enjoyment of other guests (including excessive noise), damage to the property or who exceeds the stated occupancy (unless occupancy has been agreed by both parties owner and customer direct and in advance of the let). In this case a refund of rental rate is at the entire discretion of the owner.

It is a condition of booking that a lodge may only be occupied by the person named in the booking and their family and/or companions. Cairn Lodges Ltd lodges may not be sub-let to a third party. If this is found to be the case, the third party will have no legal right of occupancy and will be required to vacate Cairn Lodges immediately.

It is forbidden for guests to erect tents or use camper-vans or caravans or any other vehicles on site for the purposes of over-night accommodation. Any guests found doing so will be asked to leave immediately.

PARKING

The turn into Cairn Lodges is a steep incline through the woods and a single track road. Care must be taken in case of onward coming traffic and families & cyclists may also be using this road.

You must not drive at more than 5mph

Each Lodge has two designated car parking spaces in the main car park area. There is no parking at the Lodges during your stay. Your car must remain in the car park. However you are able to drive to the turning point near the Lodges to drop off and pick up your luggage.

This is a deliberate policy to create the wilderness experience we believe our customers are looking for.

In the event that a party wishes to park more than two vehicles per Lodge, they must notify Cairn Lodges Ltd staff who will advise where to park the additional vehicles.

BBQ’S AND CAMP FIRES

You are not permitted to make camp fires or have BBQs anywhere except for at sites specifically designated for these purposes, and agreed between you and Cairn Lodges Ltd.

FIRE & SAFETY

As we have said a fire in the heather will travel very quickly. Please notify us immediately if you suspect a fire and call 999. Each Lodge has its own outside tap with hose pipe. There are fire beaters located around the development. There are two mains water fire hydrants clearly marked on the development. The fire safety meeting point is in the Carpark.

PETS

Dogs are the only pets allowed on the premises. No other kinds of pets are permitted. Guests must declare that they wish to bring a dog(s) at the time of booking and agree to pay the surcharge for accompanying dog(s). There is a maximum limit of two dogs for each lodge.

Sheep, wild deer and other animals roam free around the Cairn Lodges site and it is the responsibility of dog owners to keep their dog under control at all times. Guests may be required to vacate their Lodge if, after being warned that their dog is causing a nuisance, they continue to fail to control it. In such circumstance, no refund will be payable to the guest for the unexpired part of their stay. Any injury or death caused by a guest’s dog to a person, another dog, stock animal or wild animal is the responsibility of the pet’s owner. In cases of injury or death of live-stock or wild animals caused by a guest’s dog, Cairn Lodges reserves the right to charge that guest for any applicable veterinary care or animal replacement costs.

Dogs are not allowed on the furniture at Cairn Lodges and please bring your own pets bedding. If they have a tendency to chase wild animals or fight with other dogs they must be kept on a lead at all times. Any fouling close to the Lodges, roads or foot-paths should be cleaned up by the dog’s owner.

All dogs must be kept on leads when walking in the area.

There is a washing area for pets at reception, please use your own pet towels.

LANDSCAPE

We have two natural water courses at Cairn Lodges Ltd that run through the development. In places these can be difficult to see amongst the heather. They are not deep but can be boggy should however should you walk on the land it is your responsibility to take care of your own safety. The landscaping at Cairn Lodges has been left deliberately wild to create the wilderness experience we believe you, our customer, desires. Fenced off water courses would compromise this wilderness feel.

At Cairn Lodges we have a mix of woodland and scrub, blanket bog, upland heathland and bracken.

Young children, particularly toddlers must be supervised at all times.

It is your responsibility to take care of your own safety and the safety of those in your party at all times.

FUEL

Heating and hot water is provided by electric sources, this along with wifi is included in your holiday rental cost. A starter pack of logs is also included and additional logs can be purchased onsite.

ITEMS PROVIDED

Beds are made up for your arrival. Towels, tea towels, bin bags, toilet rolls and standard cleaning supplies are provided. In case of late arrival, there is a welcome pack to start you off.

Free to view smart tv’s, with Netflix, Amazon Prime etc, available via your own account details.

SMOKING

Smoking is not permitted inside the lodges but is permitted on the Cairn Lodges site outside of the buildings. You are requested to not drop cigarette ends on the ground anywhere on the site. Please take particular care during dry months as moorland fires are common in the Highlands, dead heather and bracken, dry peat are all flammable! Please take special care with your cigarette ends.

BREAKAGES

Please inform us of any breakages or damage so we can repair or replace before our next guests arrive.
Cups, glasses & plates do get damaged but any other damages and losses will be paid for in full.

CHECK IN

Check In arrival 4:00pm Check out 10:00am.

Please follow the arrival information which is sent via email to all guests.

There is a guest information book in each lodge which is for guests’ enjoyment. It contains plenty of information on things to do and see.

REPAIRS TO PROPERTY

Occasionally in rental properties damage due to possible wear and tear, an item of equipment may for some reason not be working. We will do our utmost to repair it as quickly as possible. Due to the remoteness of our location, sometimes things may take a little bit longer than they do nearer towns & cities but we will strive to correct problems should they arrive. To improve the facilities the owner’s reserve the right to alter or amend the facilities made available at the Lodge.

RIGHT OF ENTRY

The owner of the Lodges reserves the right to enter the property at an agreed time with the hirer to carry out any repairs or maintenance. The owner reserves the right to ask guests to vacate the property if their behaviour is deemed to be unreasonable or damage is caused to the property.

ITEMS LEFT BEHIND IN YOUR LODGE

Postage and packing costs only will be levied for the return of items left in the Lodge after your departure.

PERSONAL PROPERTY

As well as cancellation and curtailment insurance, clients are recommended to take out holiday insurance to cover loss or damage to personal effects.

LIABILITY

Cairn Lodges provides wilderness holidays in a genuine rural wilderness environment. You and all members of your party are responsible for your own safety.

The wilderness environment presents inherent risks, and these form part of the wilderness experience you are buying into when you stay at Cairn Lodges. You are reminded of the higher degree of risk the rural wilderness environment presents and you should take all appropriate and reasonable care for your safety and the safety of others at all times.

Cairn Lodges Ltd will have no liability for death, personal injury, or loss of, or damage to, personal property including motor vehicles. In the absence of any negligence or other breach of duty by the owner, the use by tenants of any Lodge or its facilities is entirely at their own risk.

EXTRAORDINARY CIRCUMSTANCES DURING YOUR STAY

Cairn Lodges Ltd accept no liability for events during your stay totally beyond our control, e.g. destruction of property due to flood, fire, earthquakes or acts of nature; or that the property becomes uninhabitable due to irreparable damage or on Health & Safety issues that could not reasonably have been foreseen. In such cases refunds will be at the discretion of Cairn Lodges Ltd.

COMPLAINTS

The owner hopes that you will not have any cause for complaint but in the event of a problem arising, you must in the first instance contact the owner immediately so that any problem may be speedily resolved, as the owner must be given the opportunity to rectify the problem. Some problems are very easily rectified if notified.

LAW

The contract between you and the owner is subject to Scots Law and is formed in Cairn Lodges Ltd, Arisaig, Mallaig, PH39 4NT
Please ensure you have read and understand the terms and conditions of agreement for the rental of Cairn Lodges Ltd prior to paying your deposit.
